ILLINOIS VERDICT REPORTER CONFIRMS RECORD


The Illinois Jury Verdict Reporter has confirmed that the $602,000.00 combined award obtained by attorney Michael Viglione last week in Lake County Circuit Court is a record verdict.

Viglione obtained a $552,000.00 verdict on behalf of a female client who had a prior L3-L5 fusion and L3-S1 decompression laminectomy 75 days prior to her October 18, 2014 automobile accident.  The plaintiffs claimed that the accident aggravated the female's pre-existing back issues.

LAKE COUNTY JURY AWARDS $602,000.00


A Lake County jury has awarded a 74 year old woman and her husband a combined $602,000.00 for injuries sustained in a 3 car collision on October 18, 2014.

At the time of the accident, the female Plaintiff was in recovery from a prior L3-L5 fusion and L3-S1 decompression laminectomy performed 75 days prior.  Plaintiffs alleged that the collisions caused development of chronic pain below the fusion leading to implantation of a spinal cord stimulator.  Plaintiffs claimed that the injuries derailed her recovery from surgery and severely impacted her quality of life.

Aggravation of a Pre-Existing Condition


I had neck surgery four years ago from which I fully recovered.  I was recently rear-ended and now my neck is killing me again.  Can I still recover in a personal injury case?

PEDESTRIAN ACCIDENT AWARD


Ryan, Ryan & Landa attorney Michael Viglione recently obtained a $300,000.00 personal injury award for a Lake County pedestrian that was struck by an automobile.  The award, which was reduced to $225,000.00 based upon the pedestrian's comparative fault in causing the incident, was made by a three person Underinsured Motorist arbitration panel.

The pedestrian suffered injuries to the left side of his body, including his shoulder, knee, and back/neck.

INVOLVED IN A COOK OR LAKE COUNTY AUTO ACCIDENT


I was just involved in an auto accident, what can I do right now to protect my rights?

(1) Turn your phone off:  Ok, you don't literally need to switch your phone off, but immediately stop taking calls from any numbers you don't recognize.  Insurance companies will immediately begin calling you in an effort to obtain a recorded statement concerning your collision, have you sign medical authorization forms, and ask you for a whole host of information.  Understand, these companies do not want to help you!  Their motivation is to limit your recovery in any way possible.  Do not take their calls.  It will not help your case.

Uninsured (UM) / Underinsured (UIM) Coverage Explained


My insurance agent says that I can lower my auto policy premiums by excluding and/or taking low level UM/UIM coverage, should I do it?

Answer:  No!  Uninsured motorist coverage operates as protection should you or a loved one get seriously injured by a driver who has no insurance, a drunk driver that flees an accident scene and cannot be identified, a driver whose insurer pulls coverage for the loss, etc.  

It is of great importance that you carry as much UM coverage as you can afford to protect you and your family in the event that a motor vehicle accident, trucking collision, motorcycle collision, or pedestrian accident occurs, and the at-fault driver simply does not have insurance coverage.  

UM coverage operates as a source of recovery for past and future medical bills, lost wages, pain and suffering, disability, and disfigurement.  UM compensation can be obtained through filing a claim against your own insurer and demanding formal arbitration.  The insurer must be notified and a claim must be filed (both within time periods dictated by your insurance policy) in order to obtain benefits.
