Ryan, Ryan & Landa attorney Michael Viglione recently finalized settlement of a handicap accessibility injury case for $645,000.00.  The lawsuit alleged that a commercial building owner, management company, and tenant failed to remove snow and ice from the area surrounding a handicapped parking space.  It further alleged that the snow and ice was negligently plowed into the area by a company responsible for plowing and salting the store parking lot. 

The plaintiff was injured when she fell from a plowed mound of snow while trying to walk from the handicapped space into the store.

Wrongful Death Accident

Ryan, Ryan & Landa attorney Michael Viglione recently finalized settlement of a wrongful death lawsuit filed by the family members of a 71 year old man who died due to injuries sustained in a slip and fall on snow and ice on a negligently designed handicapped parking ramp.

Due to the fact that no one witnessed the incident, Viglione was forced to prove the location and mechanism of the fall through post-occurrence witness testimony, medical records detailing the injuries sustained, and the testimony of an expert biomechanical engineer.

Additionally, Viglione enlisted an expert architect to opine as to the deficiencies of the handicapped parking ramp, its violation of various handicap accessibility laws, and how these violations caused the occurrence. 

The settlement, which earned the family $975,000.00, was a testament to hard work and what a wonderful man and father the decedent was throughout his life.

Handicap Accessibility Accidents

Handicap accessibility laws are established for a reason.

Namely, these laws reflect a general recognition that handicapped individuals deserve increased protection.  A common example of such a law in Illinois is the requirement that all handicap accessible parking spaces be maintained free of snow and ice.  All too frequently, this particular law is violated by entities such as businesses, condominium associations, and common carriers.
