NUMBERS REVEAL THERE IS NO NATIONAL OR STATE CIVIL LAWSUIT CRISIS

MEDICAL PAYMENTS COVERAGE


My husband was seriously hurt in a motor vehicle accident.  The hospital is telling me that his medical payments coverage on our auto insurance policy is his primary insurance and refusing to bill our health insurance for its services.  What should I do?

Answer:  Call an injury attorney.  Hospitals often take the position that medical payments coverage, personal injury protection (PIP) coverage, and/or the auto liability insurance coverage of the driver that caused your injuries, is considered "primary".  This is a fancy way of saying that hospitals will oftentimes try to send their bill to these sources of recovery as opposed to processing the bill through your health insurance.

ICE CAUSING MAJOR LAKE COUNTY COLLISIONS


Icy conditions cause a large amount of Lake County motor vehicle accidents and resulting injuries

Waukegan and Lake County motorists are reminded to be careful while driving.  Icy conditions over the past several days have caused a rash of collisions, some of which have been reported as the source of serious personal injuries.

Remember that driving the speed limit under difficult, dangerous conditions may not be safe enough.  Snowy, icy, and wet weather can merit drivers using extreme caution and even pulling off the road altogether unless and until it becomes safe to drive.

Train Accident


A pedestrian was struck and killed by a Metra train near the northwest suburban Woodstock Station Sunday evening.

The person was struck on the Union Pacific-Northwest Line near the Woodstock Station sometime before 6:30 p.m., according to the rail agency. It occurred near the intersection of Calhoun Street and Madison Street.

Medicare Set Asides


I am 65 years old and suffered catastrophic personal injuries in a Lake County, Waukegan, IL automobile accident.  The insurance company involved is telling me that any settlement of my claim will need to involve setting aside funds for Medicare.  What does this mean?  Is Medicare going to take my entire settlement?

Medicare is considered a secondary payor on personal injury cases.  This means that when someone 65 years of age or older gets into a motor vehicle collision or sustains injuries do to the fault of another, Medicare is considered secondary health insurance.  The at-fault individual's liability insurance is considered primary.

Magnetic Resonance Imaging (MRI)


I had an MRI which shows I do not have a herniated disc in my neck, but I'm still in pain.  My orthopedic surgeon is telling me I'm fine, is my injury case over?

Answer: Not necessarily.  Medical providers use MRI examinations as a diagnostic tool to assess for soft tissue injuries in accident victims.  The most widely known finding on an MRI involves a herniated disc.  

A herniated disc refers to a problem with one of the rubbery cushions (discs) between the individual bones (vertebrae) that stack up to make your spine.

Devastating Effects of Traumatic Brain Injuries

HANDICAP ACCESSIBILITY


Ryan, Ryan & Landa attorney Michael Viglione recently finalized settlement of a handicap accessibility injury case for $645,000.00.  The lawsuit alleged that a commercial building owner, management company, and tenant failed to remove snow and ice from the area surrounding a handicapped parking space.  It further alleged that the snow and ice was negligently plowed into the area by a company responsible for plowing and salting the store parking lot. 

The plaintiff was injured when she fell from a plowed mound of snow while trying to walk from the handicapped space into the store.
